Vyblor Refund Policy (Notice on Withdrawal of Orders)
Haechiwood (the "Company") handles withdrawals of orders and refunds for paid orders of the Vyblor service (the "Service") as set out below, in accordance with the Act on the Consumer Protection in Electronic Commerce, Etc. (전자상거래 등에서의 소비자보호에 관한 법률, the "Electronic Commerce Act") and the Terms of Service.
1. Nature of the Service and Advance Notice of Restrictions on Withdrawal of Orders
- The Service is digital content (a video) newly produced solely for the individual user, based on the URL the user ordered.
- Once production of a video has begun, the result cannot be resold. Accordingly, under Article 17(2)5 of the Electronic Commerce Act (where the provision of digital content has commenced), once the video has been delivered, withdrawal of the order for a simple change of mind or for reasons of taste is restricted. The Company displays this fact on the order screen before payment and obtains the user's acknowledgment.
- However, in the cases set out in Sections 2 to 4 below, the Company refunds or reproduces the video regardless of whether it has been delivered.
2. Full Refund
The full payment amount is refunded in any of the following cases.
- Cancellation before production starts: the user requests cancellation before the Company begins producing the video (while the order status is "Received").
- Production failure: the URL passed the pre-payment check, but the video cannot be produced for technical reasons.
- Late delivery: a reviewed video has not been delivered within 24 hours after payment is completed (for marketplace product orders, within 24 hours after the product materials have been submitted). If the user wishes, the user may choose to keep waiting instead of receiving a refund.
- Order declined: the Company declines or cancels the order under Article 8(5) or Article 10 of the Terms of Service. However, if the user engaged in conduct prohibited under Article 10(2) of the Terms of Service, the Company may refund the amount remaining after deducting the costs it actually incurred.
- Overselling of a limited quantity: the quantity available at a limited-quantity price sold out while the payment was being processed, so the order could not be accepted.
3. Where the Video Differs from the Site: Free Reproduction or Full Refund
If the video clearly differs from the order or from the site entered, as in any of the following cases, the user may, within 14 days of receiving the video, request either a free reproduction or a full refund.
- The video introduces a different service or a different product.
- Key information, such as the service name, product name or price, is shown differently from the site.
- The video claims features or effects that are not on the site.
- The video was produced in an aspect ratio or language different from the one ordered.
- The video file cannot be used normally, for example because it does not play.
This is in accordance with Article 17(3) of the Electronic Commerce Act (where the content of the goods or services supplied differs from what was labeled or advertised, or the contract was performed differently from its terms), under which the user may also withdraw the order within 30 days from the date the user knew or could have known of that fact.
4. Matters of Taste
- Matters of taste, such as mood, color, direction and choice of music, are not grounds for a refund. These are addressed through the one revision included in the order, and revisions after that can be purchased as additional revisions (add-ons).
- Revision requests are reflected more accurately when they state specifically which scene (at which second), what, and how the user wants changed.
5. Add-ons
- Add-ons, such as additional revisions, removal of the credit line (end card) and production in an additional aspect ratio, are refunded in full if they have not yet been provided.
- Once an add-on has been provided, it is not refunded except in the cases set out in Sections 2 and 3.
6. Credits and Recurring Payments (Applies only when this service is offered)
- Paid Credits: unused paid Credits are refunded in full within 7 days of the top-up date. After that, the refund is the amount corresponding to the remaining paid Credits minus 10% of the payment amount (minimum ₩1,000). Credits granted free of charge are not refunded, and where Credits have been partly used, paid Credits are deemed to have been used first.
- Recurring payments: users may cancel a recurring payment at any time, and upon cancellation no further payments are charged from the next scheduled payment date. If, within 7 days of the payment date, the user has not used any of the benefits of that billing cycle, the full amount is refunded; if the user has used part of them, the refund is calculated based on the portion already used and the remaining period.
7. Free Applications
Videos produced free of charge involve no payment and are therefore not eligible for refund. Withdrawal of consent to showcase publication is governed by Article 16 of the Terms of Service.
8. How to Request a Refund and Processing Times
- How to request: use "Request a refund" on the order status page, or email [email protected] with your order number and the reason.
- Processing: the Company informs the user whether a refund will be made within 3 business days of receiving the request, and once a refund is decided, cancels the payment on the original payment method (credit card) through the payment service provider. Under Article 18 of the Electronic Commerce Act, the Company initiates the refund of amounts to be refunded due to withdrawal of the order or similar within 3 business days from the date the goods or services are returned (for digital content, the date the Company receives the user's expression of intent to withdraw).
- When the refund appears: when a card payment cancellation actually appears on the card statement varies by card issuer, and typically takes 3 to 7 business days from the cancellation date.
- Partial refunds: where part of the amount is refunded, it is processed as a partial cancellation.
