Vyblor Terms of Service
Article 1 (Purpose)
These Terms set out the rights, obligations and responsibilities of Haechiwood (the "Company") and its users, and the conditions and procedures for use, in connection with the use of Vyblor (vyblor.com, the "Service") operated by the Company.
Article 2 (Definitions)
The terms used in these Terms have the following meanings.
- "Service" means the Company's online service that uses artificial intelligence (AI) to produce and deliver an introduction video of approximately 15 to 25 seconds (a "Video") based on the address (URL) of a website or product page entered by the user and its publicly available content.
- "User" means a member or non-member who uses the Service in accordance with these Terms.
- "Member" means a person who has created an account through the procedure set by the Company, such as email verification.
- "Order" means a user's request for the production of a Video, and includes both free applications and paid orders.
- "Input Materials" means all materials used to produce a Video, including the URL provided by the user, the publicly available text, images and screens of that page, the service name, the features the user wants to highlight, and any uploaded files.
- "Revision Request" means a user's request to change a specific scene or text in a delivered Video.
- "Add-on" means a product purchased for a separate fee in addition to the basic order, such as additional revisions, removal of the credit line (end card), or production in an additional aspect ratio.
- "Credits" means in-service units of use that are charged or granted by methods set by the Company and can be used for paid features of the Service. (Applies only when this service is offered.)
- "Recurring Payment" means a method by which a fee is automatically charged at fixed intervals to the payment method registered by the user. (Applies only when this service is offered.)
- "Showcase Publication" means, only where the user has given separate consent, the Company's posting of a completed Video as a production example on the Company's website and social media accounts.
Article 3 (Posting and Amendment of the Terms)
- The Company posts the contents of these Terms, together with its trade name, the name of its representative, the address of its place of business, its telephone number, email address, business registration number and mail-order business registration number, on the Service screen so that users can easily find them.
- The Company may amend these Terms to the extent that doing so does not violate applicable laws, including the Act on the Regulation of Terms and Conditions (약관의 규제에 관한 법률) and the Act on the Consumer Protection in Electronic Commerce, Etc. (전자상거래 등에서의 소비자보호에 관한 법률).
- When the Company amends these Terms, it announces the effective date, the amended content and the reason for the amendment on the Service screen from 7 days before the effective date. However, changes unfavorable to users are announced from 30 days before the effective date, and members are notified individually at their registered email address.
- If the Company, in its announcement or notice under paragraph 3, clearly states that "failure to express refusal by the effective date will be deemed consent" and the member does not expressly refuse, the member is deemed to have agreed to the amended Terms. A member who does not agree to the amended Terms may terminate the service agreement.
- The amended Terms apply only to orders concluded on or after the effective date; orders concluded before that date remain subject to the Terms in force before the amendment.
- The Company retains previous versions of these Terms without deleting them, and users can view previous versions on the Service screen.
Article 4 (Rules Other Than These Terms)
Matters not set out in these Terms, and the interpretation of these Terms, are governed by applicable laws, the Refund Policy and Privacy Policy established by the Company, and the standard terms and conditions for electronic commerce established by the Fair Trade Commission and commercial practice.
Article 5 (Membership and Accounts)
- Membership is created when the user enters an email address and confirms ownership of that email by entering the 6-digit verification code the Company sends to that address. The Company may later add login methods using social accounts (for example, Google, Kakao or Naver), and accounts verified with the same email address may be linked into a single member account.
- Persons under the age of 14 may not register as members or place orders.
- Members must keep their account information accurate and must not use another person's email address without authorization.
- Members are responsible for preventing third parties from using their account and verification codes, and must notify the Company immediately upon becoming aware that their account has been misappropriated.
- The Company may decline an application for membership, or subsequently terminate the service agreement, in any of the following cases.
- The applicant has misappropriated another person's information.
- The applicant's use was previously restricted for violating these Terms.
- The applicant attempts to register in bulk by automated means.
Article 6 (Content of the Service)
- The Company provides the following services.
- Production of an introduction Video based on the Input Materials (with background music, without narration)
- Delivery of the Video, a representative image (poster) and copy for sharing
- One revision included in the order, and paid additional revisions
- Add-ons
- Other services that the Company additionally develops or provides through partnerships
- Videos are produced in the aspect ratio selected by the user (one of vertical 9:16, square 1:1 or horizontal 16:9) and in the language selected by the user (Korean, English or another language offered by the Company).
- The Service uses artificial intelligence to create its output. The Company may have a person review a Video before delivery, but such review does not guarantee the completeness or accuracy of the output.
- The Company endeavors to deliver the Video within the period shown on the order screen (for paid orders, 24 hours after payment is completed; for marketplace product orders, 24 hours after the user has finished submitting the product materials such as screenshots of the detail page and reviews), and if it fails to deliver within that period, the matter is handled in accordance with the Refund Policy.
Article 7 (Notice of AI-Generated Content)
- Videos produced through the Service are output created using generative artificial intelligence. The Company informs users of this fact before they place an order.
- In accordance with applicable laws (such as the Framework Act on the Development of Artificial Intelligence and the Establishment of a Foundation for Trust (인공지능 발전과 신뢰 기반 조성 등에 관한 기본법)), the Company indicates that a Video was created with generative artificial intelligence in a machine-readable way, such as in the file metadata. No separate "AI-generated" caption is placed inside the picture of the Video.
- When posting or distributing a Video, users must not mislead others into believing that the Video was filmed or made directly by a person, and must follow the policy of the platform on which they post it where that platform requires AI-generated content to be labelled.
Article 8 (Orders and Formation of the Contract)
- Users place an order by entering and confirming the following on the Service screen.
- The URL for which the Video is to be produced and the service name (or product name)
- The aspect ratio, the language, and the content to highlight (optional)
- Confirmation of authority and content warranties (Article 9)
- Consent to the collection and use of personal information, acknowledgment of the notice of AI-generated content, and acknowledgment of the notice on restrictions on withdrawal of the order
- Consent to Showcase Publication (optional; required for free applications), consent to use in paid advertising (optional), and consent to receive marketing information (optional)
- Before payment, the Company may automatically check whether the entered URL is suitable for Video production (whether it is publicly accessible, whether login is required, whether its content is sufficient, and so on). If it is not suitable, the Company does not proceed with payment and explains the reason.
- The contract for a paid order is formed when payment is completed and the Company notifies the user that the order has been received. A free application is formed when the Company notifies the user that the application has been selected.
- Free applications are selected according to criteria set by the Company, and the Company may choose not to disclose the reason an application was not selected.
- The Company may decline or cancel an order and refund the full payment amount in any of the following cases.
- The URL or content falls under the prohibited categories in Article 10.
- The content of the page cannot be obtained for technical reasons.
- The quantity available at a limited-quantity price has already sold out.
- Accepting the order would otherwise significantly impair the Company's performance of its business.
Article 9 (User Warranties)
- The user warrants the following.
- The user is the operator or seller of the website, service or product at the entered URL (including a product page on an online marketplace such as Naver Smart Store), or has been authorized by the operator or seller to request the production of a Video.
- The user holds the rights to use any photographs, faces, reviews, client logos, trademarks, music and the like of other persons contained in the Input Materials, and will ask, at the time of ordering or through a Revision Request, for any material for which the user lacks such rights to be removed from the Video.
- Advertising claims contained in the Input Materials about a product or service, such as its efficacy, performance, ranking, sales volume, discount rate, awards or before-and-after comparisons, are true and objectively substantiated. For products whose labeling and advertising are specially regulated, such as cosmetics, health functional foods, foods and medical devices, the user complies with applicable laws, including the Act on Fair Labeling and Advertising (표시·광고의 공정화에 관한 법률), the Cosmetics Act (화장품법), the Health Functional Foods Act (건강기능식품에 관한 법률) and the Act on Labeling and Advertising of Foods (식품 등의 표시·광고에 관한 법률).
- Because a Video is a reconstruction of the content of the Input Materials, the Company does not warrant the truthfulness or lawfulness of the Input Materials. If the user's breach of paragraph 1 causes damage to the Company or a third party, the user bears responsibility for that damage.
- The Company may remove or change, in a Video, any expression it judges likely to violate the law (for example, an unsubstantiated claim of being "No. 1", an expression claiming to prevent or treat disease, or an expression that could be mistaken for a medicine), ask the user to confirm the supporting evidence, or refuse to produce the Video.
- When a Video quotes a product review, the Company does not display the reviewer's name or username, and quotes only briefly without distorting the intent of the original.
Article 10 (Prohibited Content and Prohibited Conduct)
- The Company does not produce Videos for URLs or content falling under any of the following.
- Obscene material, adult services, or content harmful to children and adolescents
- Gambling and speculative services, illegal finance or unauthorized fund-raising, or illegal lending
- Products whose advertising is prohibited or restricted by law, such as medicines, narcotics and weapons
- Content that promotes hatred, discrimination or violence
- Services that deceive consumers, such as fraud, phishing and pyramid schemes
- Content that synthesizes a real person without consent or defames a real person
- Content that infringes the rights of others, such as copyrights, trademark rights and portrait rights
- Any other content contrary to law or public order
- Users must not engage in any of the following conduct.
- Placing an order for another person's website or product page without authority
- Placing orders in bulk by automated means or placing an excessive load on the Service
- Placing an order for a page containing content intended to interfere with or manipulate the Service or the Video production process (for example, instructions directed at the production tools)
- Reverse-engineering the Service, or reselling the Service without the Company's permission
- Fraudulent use of a payment method
- If a user violates paragraph 1 or paragraph 2, the Company may cancel the order or restrict the user's use, and any refund in that case is governed by the Refund Policy.
Article 11 (Paid Services and Payment)
- The types, prices (including value-added tax), delivery periods and content of paid services are as displayed on the Service screen. The Company may offer discounted prices for a set quantity or period, in which case it displays the quantity on sale and the remaining quantity on the screen.
- Payment is made using the payment methods offered by the Company (such as credit cards) and is processed through a payment service provider (electronic payment gateway) under contract with the Company. The Company does not itself store users' payment method information, such as card numbers.
- The payment amount is the amount set on the Company's server, and no payment is formed for an amount altered on the user's device.
- Add-ons may be purchased separately after the Video is delivered, and the price and content of each add-on are displayed on the purchase screen.
- Withdrawal of the order and refunds are governed by the Company's Refund Policy.
Article 12 (Credits) (Applies only when this service is offered)
- The Company may provide Credits by methods such as paid top-ups and promotional grants, and displays where Credits can be used, how they are deducted and their period of validity on the top-up or grant screen.
- Credits purchased through a paid top-up are valid for 5 years from the date of top-up, and the period of validity of Credits granted free of charge by the Company through promotions or otherwise is set separately at the time of the grant.
- Refunds of unused paid Credits are governed by the Refund Policy. Free Credits are not eligible for refund.
- Credits cannot be transferred to other members or exchanged for cash.
Article 13 (Recurring Payment) (Applies only when this service is offered)
- When a user subscribes to a recurring payment product, the fee is charged automatically, at the interval and in the amount shown on the product screen, to the payment method (billing key) the user registered in the payment service provider's payment window.
- When accepting a recurring payment subscription, the Company clearly informs the user of the payment interval, the payment amount, the next scheduled payment date and how to cancel. If the payment amount changes, the Company notifies the user by email at least 30 days before the change takes effect and obtains the user's consent.
- Users may cancel a recurring payment at any time on the Service screen, and upon cancellation no further payments are charged from the next scheduled payment date. Use of, and refunds for, periods already paid are governed by the Refund Policy.
- If a recurring payment fails, for example because the payment method's limit has been exceeded, the Company notifies the user and may retry the payment for a set period. If payment is not made within that period, the Company may stop providing the recurring payment product.
- When a user cancels a recurring payment or withdraws membership, the Company deletes the registered billing key.
Article 14 (Delivery and Revision of Videos)
- When a Video is completed, the Company sends a private viewing and download link to the user's email address. This link is not exposed to search engines, but anyone who has the link can view the Video, so the user is responsible for managing the link.
- Because emails sent by the Company may be classified as spam, a user who has not received an email within 24 hours of ordering must check the spam folder and, if the email is not there either, contact [email protected] or use the order status page.
- A paid order includes one Revision Request. A Revision Request must be made on the order status page or the Video delivery page, stating specifically which scene (at which second), what, and how the user wants changed.
- A revision means changing scenes, text, order, timing and the like within the scope of the existing Video. Making a new Video for a different URL or a different product is not a revision but a new order.
- Additional revisions beyond the included revision may be purchased as add-ons.
- The Company retains Video files for at least 90 days from the date of delivery and may delete them after that. Users must download and keep their Videos within this period.
Article 15 (Intellectual Property Rights and Rights of Use)
- Users may freely use, post and edit the delivered Video for any lawful purpose, including commercial purposes. However, rights in the Input Materials contained in the Video (such as logos, trademarks, screens and images of the user or third parties) remain with their original rights holders.
- The background music used in a Video has been generated by the Company or licensed to it. Users may use the music only as part of that Video and may not distribute or sell the music separately.
- Intellectual property rights in the Service, the design of the Service screens, the Video production method, templates, programs and the like belong to the Company.
- The Company does not use Input Materials or Videos to train artificial intelligence models without the user's separate consent (opt-in).
Article 16 (Showcase Publication)
- Only where the user has consented to Showcase Publication may the Company post the completed Video (including the service name, product name, logo and screens) as a production example on the website and social media accounts operated by the Company, such as Threads and Instagram. Consent to Showcase Publication is optional for paid orders, and free applications are conditional on consent to Showcase Publication.
- Consent to Showcase Publication does not include use as material for paid advertising; use in paid advertising occurs only where separate consent has been obtained.
- The Company posts only the final Video approved by the user, and may post it after confirming ownership of the website or conducting an internal review. A post may be accompanied by an "AI-generated" label and a link to the user's website. 3-2. The option "I would like Vyblor to promote my completed video" on the order screen is selected by default. Users may deselect it before ordering, and may turn it on or off at any time with the "Promote this video on Vyblor" setting on the Video delivery page.
- Users may withdraw their consent to Showcase Publication at any time by email ([email protected]), on the Video delivery page or on the Service screen, and the Company takes down the posts it controls within 24 hours of receiving the request. The Company cannot guarantee the deletion of copies already shared or saved by third parties.
- For free applications, a credit line such as the user's account name appears on the Video's end card, and the user may remove it by purchasing an add-on.
Article 17 (Changes to and Suspension of the Service)
- The Company may change the content of the Service where necessary for operational or technical reasons, and gives advance notice of material changes unfavorable to users by the method set out in Article 3.
- The Company may temporarily suspend the Service in unavoidable circumstances, such as the inspection, replacement or failure of equipment, communication outages, outages of external services (artificial intelligence, payment, hosting and the like) or natural disasters. If, as a result, a Video cannot be delivered within the promised period, the matter is handled in accordance with the Refund Policy.
Article 18 (Termination of the Service Agreement and Restriction of Use)
- Members may request withdrawal of membership at any time on the Service screen or by email, and the Company deletes the member's information without delay, except for information that must be retained under applicable laws. If there is an order in progress, the Company explains how that order will be handled.
- If a member violates these Terms, the Company may, after prior notice, restrict the member's use or terminate the service agreement. However, where the violation is serious or urgent, the Company may give notice afterwards.
Article 19 (Disclaimers and Limitation of Liability)
- The Company compensates users for damage caused by the Company's intent or negligence.
- Unless the Company has acted with intent or gross negligence, the Company is not liable for the following damage.
- Damage arising because the content of the Input Materials provided by the user is untrue or infringes the rights of a third party
- Outcomes of the user posting a Video or using it in advertising (such as advertising effectiveness or sales)
- Disruptions to the use of the Service caused by reasons attributable to the user
- Matters of taste, such as the aesthetic quality, mood or direction of a Video, are not warranted by the Company, and are addressed through the included revision and additional revisions.
- To the extent permitted by applicable laws, the Company's liability for damages is limited to the amount actually paid by the user for the order concerned. However, this limit does not apply to damage caused by the Company's intent or gross negligence, or to liability that cannot be limited under the Act on the Regulation of Terms and Conditions.
Article 20 (Notices to Users)
- When the Company gives individual notice to a user, it does so to the email address the user entered when ordering or registering.
- Notice to a large, unspecified number of users may be given in place of individual notice by posting it on the Service screen for at least 7 days. However, material matters unfavorable to users are notified individually.
- Emails necessary for transactions, such as order confirmations, Video deliveries and payment or refund notices, are not advertising information and are sent regardless of whether the user has consented to receive marketing. Advertising information is sent only to users who have given separate consent.
Article 21 (Dispute Resolution and Governing Law)
- The Company receives users' complaints and requests for remedies at [email protected], and informs the user of the outcome or the handling schedule within 3 business days of receipt.
- Disputes between the Company and users are governed by the laws of the Republic of Korea.
- Any lawsuit relating to the use of the Service is brought before the court having jurisdiction under the Civil Procedure Act (민사소송법). Users may apply for mediation to dispute mediation bodies such as the Korea Consumer Agency and the E-Commerce Mediation Committee.
